Alternative dispute resolution (or “ADR”) is a term referring to dispute resolution processes and techniques that act as a means for disagreeing parties to resolve a dispute without filing a public lawsuit that is heard in a courthouse. The two most common forms of ADR are mediation and arbitration.
Mediation is usually a negotiation between two or more parties in dispute, which is conducted by an independent facilitator called a mediator. The parties are usually in separate rooms, and the mediator serves as a go-between, moving from room to room communicting the other side’s respective position. The mediator’s role is to assist the parties in reaching an amicable agreement that resolves the dispute.
